(ORAL) The petitioner had filed a criminal complaint dated 15.12.2009 before JMIC, Nabha against respondents No.2 and 3 for having caused injuries to her.
The said complaint is stated to be pending in the Court of Ms.Meenakshi Gupta, JMIC, Nabha.
It is contended in the petition that respondents No.2 thereafter moved an application/complaint dated 23.04.2013 before learned JMIC, Nabha for registration of criminal case against the petitioner for having tampered with judicial record.
It is averred in the petition that consequent to the filing of the complaint above-said by respondents No.2 and 3, the District & Sessions Judge, Patiala-respondent No.1 marked an enquiry to the Court of learned JMIC, Nabha.
The said enquiry was conducted and an enquiry report dated 18.05.2013 was stated to be submitted by the Civil Judge (Jr.
Division).Nabha to respondent No.1-District and Sessions Judge, Patiala.
Counsel for the petitioner submits that the petitioner needs a certified copy of the said enquiry report for the purpose of submitting reply to the complaint/application dated 23.04.2013 made against her.
He further submits that petitioner had also applied for certified copy of the said enquiry report and that Pooja Saini respondent No.1 has returned the application to supply the same and instead directed 2014.06.20 10:25 I attest to the accuracy and integrity of this document Chandigarh CWP No.12092 of 2014 2 the petitioner to inspect the record.
He further submits that the petitioner is entitled for getting the certified copy of the enquiry report along with documents, if any.
In view of the aforesaid contentions, the District & Sessions Judge, Patiala is directed to look into the contentions of the petitioner as to whether any such enquiry was marked and whether the said report was submitted.
If such a report is available with the Court, then the certified copy be supplied to the petitioner.
Disposed of, accordingly.
