Judgment:
Criminal Misc.No.M-20899 of 2014 (O&M) -1- IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH Criminal Misc.No.M-20899 of 2014 (O&M) Date of Decision: June 20, 2014 Hardeep Singh ......Petitioner versus State of Punjab ......Respondent CORAM: HON'BLE Mr.JUSTICE NARESH KUMAR SANGHI Present: Ms.Hemlata Issar, Advocate for the petitioner.
*** Naresh Kumar Sanghi, J.
Prayer in this petition is for grant of anticipatory bail to the petitioner, Hardeep Singh son of Surender Singh, resident of H.No.13, Village Balauli, Tehsil Chhachhrauli, District Yamuna Nagar, who has been booked for having committed the offences punishable under Sections 406, 420 read with Section 120-B, IPC, in a case arising out of FIR No.134, dated 20.06.2012, registered at Police Station, Phase-I, Mohali.
Learned counsel contends that the petitioner was an employee of the main accused and he has falsely been implicated in the present case.
She further contends that in a similar situate case, the co-accused has been granted interim bail vide order dated 30.05.2014 passed in CRM-M-19559-2014 I have heard the learned counsel for the petitioner and with her able assistance gone through the material available on record.
Meenu 2014.06.20 14:25 I attest to the accuracy and integrity of this document chandigarh Criminal Misc.No.M-20899 of 2014 (O&M) -2- The proceedings for declaring the petitioner as proclaimed offender have already been initiated.
Allegations against the petitioner are that he alongwith the co-accused duped the complainant to part with `3.52 lacs so that he (complainant) might be sent to some foreign country.
The complainant was neither sent to foreign country nor his money, charged by the petitioner and his co-accused, was returned.
The submission of the learned counsel that the co-accused of the petitioner has been granted interim bail in a similar situate case is also found to be wrong since CRM-M-19559-2014 filed by co-accused Parteek Sood @ Rahul was a quashing petition and some interim order was passed in the said case.
Keeping in view the totality of the facts and circumstances of the case, no ground for grant of concession of anticipatory bail is made out.
Dismissed.
