FIR was registered in this case for the offences punishable under Sections 307 read with Section 34 of Indian Penal Code and 25 and 27 of Arms Act, 1959 with the allegations that the shots were fired by the petitioner and his co-accused on the car of complainant but no injury was caused.
Learned counsel for the petitioner submits that matter has been compromised in this case.
A quashing petition bearing No.CRM-M- 19638 of 2014 has been filed in which notice of motion has been issued for 11.07.2014.
Parminder Singh co-accused has been allowed anticipatory bail, in CRM-M-27825 of 2011 vide order dated 15.02.2012 Mehta Sachin 2014.06.19 16:14 I attest to the accuracy and integrity of this document CHANDIGARH CRM-M-19156-2014 -2- while the other co-accused Rachhpal Singh @ Ravi has been allowed regular bail vide order dated 30.05.2014 passed in CRM-M-17981 of 2014.
The petitioner has been arrested in this case on 17.04.2014.
No specific role has been attributed to the petitioner.
Keeping in view the submission made by learned counsel for the petitioner, facts and circumstances of the case and the fact that Co.accused have already been granted bail, the present petition is allowed.
Petitioner Gurtej Singh @ Raju is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Moga subject to following terms:- a.
The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.b.
In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn.
The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law.
In that eventuality the petitioner shall have to apply for bail afresh before the trial Court.c.He shall not leave the country without the previous permission of the Court.
