Learned counsel for the applicants states that he does not wish to file any rejoinder in the matter since the controversy involved in this O.A. has already been put to rest by the Jodhpur Bench of this Tribunal in O.A. No.34/2008 titled Ram Kumar and Ors. Vs. Union of India and another decided on 05.11.2009 (Annexure A-1). He further submits that the said order has also been complied with by the respondents vide order dated 01.8.2012 (Annexure A-3). He, therefore, submits that this O.A. may be disposed of in the same terms.
2. On the consent of parties, matter is taken for hearing.
3. The relief claimed in the O.A. is to direct respondents to grant NDA (Night Duty Allowance) to the applicants w.e.f.01.1.1986, with all consequential benefits.
4. We have perused order passed by the Jodhpur Bench of this Tribunal in O.A. No.34/2008 and find that the relief claimed in the present O.A. is identical to that O.A. Even in written statement in para Relief Sought, the respondents have also admitted that in order to implement the order passed by Jodhpur Bench of this Tribunal, necessary action to consider the enhancement of NDA to all categories of defence employees is in progress under MOD and the same has already been conveyed to the applicants vide letter No.17 (4)/2012/D/ (Civ-II) dated 04.1.2013.
5. Considering that the case of the applicants is identical to the case of Ram Kumar and Ors. Vs. Union of India (Supra), this O.A. is disposed of in the same terms.6. The above exercise be carried out within three months from the date of receipt of a certified copy of this order.7. With this, the O.A. stands disposed of.No costs.
