1. This Original Application has been filed under Section 19 of the Administrative Tribunals Act, 1985, seeking the following relief:-

8 (i). to prohibit respondents from filling up the posts of Mate (Semi-skilled) by resorting to direct recruitment in violation to Recruitment Rules.

(ii). to annul and quash the order dated 8.02.2011 and subsequent clarifications on the subject in the form of letter dated 23.03.2012 as in this letter besides giving clarifications the formation of new service known as Multi Tasking Staff has been mentioned for the categories of chowkidars / safaiwals;

(iii). to command and direct the respondents to merge the categories of chowkidars / safaiwalas with Mate (semi-skilled) in accordance with the Recruitment Rules and accord them seniority from the due date with consequential benefits; like their counter parts in the category of Mazdoors.

2. Written statement was filed on behalf of the respondents and rejoinder was also filed on behalf of the applicants.

When the matter came up for consideration today, Mr. A.K.Sharma, learned counsel appearing on behalf of the applicants stated at the Bar that the relief sought by the applicants in the present OA has been allowed in an identical matter in OA No.150/PB/2013, decided on 10.03.2014 and the applicants would be satisfied if similar directions are passed in the present OA.

4. Mr. Deepak Agnihotri, learned counsel for the respondents does not controvert the submission made by the learned counsel for the applicants.5. Hence the present OA is disposed of with the direction that the respondents may consider the claim of those applicants who had passed the Trade test prior to 07.07.2013 for promotion as Mates.  If some of their juniors have been promoted earlier to the applicants, this aspect may also be addressed while considering the promotion of the applicants as Mates in accordance with SRO No.169 of 2004.  Such consideration may be effected within a period of 60 days from the date of receipt of a certified copy of this order being served upon the respondents. No costs.
