Jaspal Singh, J.(Oral) Challenge in the instant writ petition, preferred under Articles 226/227 of the Constitution of India, is to the order dated February 11, 2014 (Annexure P-1) passed by Deputy Director, Urban Local Bodies, Amritsar region exercising the powers of Collector under the Punjab Public Premises and Land (Eviction and Rent Recovery) Act, 1973 (for short 'the Act').vide which the petition under Sections 5 and 7 of the Act was accepted for eviction of the petitioner from the demise premises.
The petitioner preferred statutory appeal under Section 9 of the Act before the Deputy Commissioner, exercising the powers of Commissioner, challenging the order dated February 11, 2014, which is still pending disposal.
Alongwith the grounds of appeal, an application for staying operation of the impugned order was also filed.
Despite, the fact that the appeal has been adjourned time and again but no order has been passed on the stay application, as a result, whereof, respondent No.2 issued the impugned Sunder Sham 2014.06.13 10:37 I attest to the accuracy and integrity of this document CWP No.11977 of 2014 --2-- directions for delivery of possession vide Annexure P-4.
Since the matter is still sub-judiced before respondent No.1, the issuance of order dated May 29, 2014 (Annexure P-4) is not justified.
The instant petition is disposed of with a direction to respondent No.1 to dispose of the application moved by the petitioner for staying operation of the impugned order dated February 11, 2014 (Annexure P-1) by June 30, 2014.
