(ORAL) Respondent No.7- DSP Puran Chand is present in the Court.
He states that he is neither related to any accused nor he intends to arrest the petitioners at this stage but being entrusted with investigation of this case he requires the presence of the petitioner.
He has submitted that in case on the basis of material gathered during the couRs.of inquiry/investigation arrest of petitioners is required to be affected, 4 days’ notice in writing will be issued to them.
He has also submitted that a notice under Section 160 Cr.P.C.will Gupta Sanjay 2014.06.12 10:32 I attest to the accuracy and integrity of this document High Court Chandigarh CRM M-19206 of 2014 [2].be sent to the petitioners specifying the date and time when they are required for the purpose of inquiry/investigation.
In view of said statement counsel for the petitioners seeks permission to withdraw the petition.
Petition is disposed of as withdrawn with a direction that in case the petitioners are required to be joined for the purpose of any inquiry/investigation they will be issued notice under Section 160 Cr.P.C.with a specific date, time and place for joining investigation but in case they are required to be arrested as accused on the basis of investigation/inquiry they will be issued 4 days notice in writing in order to enable them to avail the legal remedy available to them.
While disposing of this petition, a direction is issued that petitioners will appear before respondent No.7 on June 28, 2014 at 10.00 am and that they will furnish their correct address, telephone number and place of abode.
