(Oral) The petitioners pray for protection of their life and liberty as they have of their own solemnized their marriage amongst themselves.
Both the petitioneRs.it is stated, are major.
The date of birth of petitioner No.1 is 10.10.1989 while that of petitioner No.2 is 28.7.1986.
The petitioners disclosed their intention to marry each other to their respective parents.
The parents of petitioner No.2 were happy with the marriage.
However, the parents and relatives of petitioner No.1 declined the proposal to marry petitioner No.2.
The relatives of petitioner No.1, who are parents (respondents No.5 and 6).uncle (respondent No.7) and brothers (respondents No.8 and 9).in fact, wanted to marry petitioner No.1 to a boy of their own choice.
Therefore, the petitioners of their own have solemnized their marriage at Gurudwara Criminal Miscellaneous No.M- 19767 of 2014 2 Shiromani Saheed Baba Sangat Singh Ji, Kila Fatehgarh Road, Anandpur Sahib, according to Sikh rites and ceremonies, on 29.5.2014.
Photographs (Annexure P-3) of the marriage have been placed on record.
Petitioner No.1 made a telephone call to her house after the marriage that she had married petitioner No.2 of her own sweet will.
Respondents No.5 to 9, thereafter, have been threatening petitioner No.2 and his parents to either send petitioner No.1 back or they would get registered a false case against petitioner No.2 and his family members to teach them a lesson for performing the marriage.
The petitioners approached the Station House Officer, Police Station, Yadhowal Basti, Ludhiana (respondent No.4) to provide them protection but he flatly refused to receive any complaint or take any action.
The petitioners also moved a representation (Annexure P-4) to the Commissioner of Police, Ludhiana (respondent No.2) seeking protection of their life and liberty.
However, no action has been taken.
It is submitted that despite the representation (Annexure P-4).the petitioners apprehend threat to their life and liberty.
Both the petitioners are present in Court and are identified by their counsel.
It is stated by the petitioners that they have solemnized their marriage with each other of their own free will and desire and without any kind of pressure or undue influence.
It is also stated by the petitioners that they were not earlier married.
Besides, they are happy with their marriage.
Keeping in view the facts and circumstances of the Criminal Miscellaneous No.M- 19767 of 2014 3 case, the criminal miscellaneous petition is disposed of with a direction to respondents No.2 and 3 that in case the petitioners approach any of them setting out their grievances as have been made in the present petition, the same would be looked into and considered by them independently and in accordance with law.
