(Oral) This order shall dispose of the instant petition preferred under Section 438 Cr.P.C.seeking the concession of anticipatory bail to the petitioner in case FIR No.21 dated 27.02.2014, under Sections 406, 498-A IPC, registered at Police Station Women Patiala, District Patiala.
On 11.04.2014, the petitioner had been directed to join investigation and to appear before the Investigating Officer on 16.4.2014.
Simultaneously ad-interim protection as regards arrest had been granted to the petitioner.
Learned State counsel upon instructions from HC Baljinder Singh would apprise the Court that the petitioner has since joined the investigation.
That apart, a perusal of the FIR would reveal that the allegations levelled by the complainant against the present petitioner i.e.her husband as also her in-laws are vague in nature.
There is no Kanchan mention of any specific entrustment of dowry articles.
Further 2014.05.12 17:35 I attest to the accuracy and integrity of this document Chandigarh CRM-M No.10867 of 2014 2 allegation is that she was thrown out of the matrimonial house more than one and half years back.
Surprisingly prior to registration of the FIR in February, 2014, no complaint was lodged by the present complainant with regard to harassment and cruelty.
In the totality of circumstances, this Court is of the considered view that the petitioner is entitled to the concession of anticipatory bail.
Accordingly, the present petition is allowed and the order dated 11.04.2014 is made absolute.
Petition disposed of.
