The petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Usha Vishali Malhotra alleging that she was married to the petitioner on 11.10.1992.
The petitioner had allegedly tortured the complainant by demanding dowry.
He has allegedly married another lady in July 2011.
Counsel for the petitioner has made an attempt to satisfy this court that the allegations in the FIR have been unnecessarily exaggerated.
It is urged that in the month of May 2011 the matter was compromised and a hefty sum of Rs.40 lacs, two cars and 150 tolas of gold were given to the complainant.
I have considered the contention of counsel for the petitioner in order to establish that some money has been given to the complainant.
Some withdrawal entries have been relied upon by counsel for the petitioner, which are not sufficient enough to indicate that withdrawn amount was handed over to the complainant.
In view of the serious allegations against the petitioner of having failed to discharge the matrimonial obligations despite the fact that marriage is more than21 years old, I do not find any extra- ordinary exceptional circumstances to grant pre-arrest bail to the petitioner.
Dismissed.
Nothing mentioned in the order will prejudice the right of the petitioner to seek the concession of regular bail or approach this court again if the matter is amicably resolved.
