(oral) petitioner seeks anticipatory bail under section 438 cr.p.c.in fir no.128 dated 27.10.2013 for offences under sections 326, 324, 323, 148 and 149 of indian penal code (ipc).registered at police station mehtiana, district hoshiarpur. when the matter was listed on 30.01.2014, following order was passed:- it is inter alia contended that the incident took place on 14.9.2013 whereas the fir was registered on 27.10.2013 on the statement of gurwinder singh s/o pargat singh who is an injured on the side of the petitioner. it is only on the cross-version that the petitioner apprehends arrest for causing injury on the person of simarjit singh. it is further contended that there are two injured on the side of the petitioner. it is also contended that though in the cross-version, it was stated by simarjit singh that he does not know who had jitender kumar 2014.03.24 15:17 i attest to the accuracy and integrity of this document chandigarh crm-m-3561 of 2014 -2- inflicted injury on his person but in the supplementary statement it was stated that the petitioner had caused injury on the right bicep of simarjit singh which was simple in nature. notice of.....

(Oral) Petitioner seeks anticipatory bail under Section 438 Cr.P.C.in FIR No.128 dated 27.10.2013 for offences under Sections 326, 324, 323, 148 and 149 of Indian Penal Code (IPC).registered at Police Station Mehtiana, District Hoshiarpur.

When the matter was listed on 30.01.2014, following order was passed:- “ It is inter alia contended that the incident took place on 14.9.2013 whereas the FIR was registered on 27.10.2013 on the statement of Gurwinder Singh S/o Pargat Singh who is an injured on the side of the petitioner.

It is only on the cross-version that the petitioner apprehends arrest for causing injury on the person of Simarjit Singh.

Notice of motion for 24.3.2014.

Meanwhile, in the event of arrest of the petitioner, he shall be released on bail by the Arresting/Investigating Officer.

The petitioner shall abide by the conditions as enshrined in Section 438 (2) Cr.P.C.”

Learned State counsel on instructions from HC Jugraj Singh submits that the petitioner has joined the investigation and is stated to be no more required for further investigation.

The petitioner has been attributed injury inflicted with kirpan on left arm of the complainant which is simple in nature.

In view of the above and without commenting on merits of the case, the interim bail granted vide order dated 30.01.2014 is made absolute.
