(ORAL) C.M.No.17045 of 2013 This is an application for placing on record some documents.

Application is allowed as prayed for.

Documents are taken on record as Annexures P7 to P9.

CWP No.1607 of 2012 Petitioner is aggrieved against the appointment of Vikram Singh (respondent No.4) as Lambardar of village Khaleta, District Rewari by the Collector, Rewari vide his order dated 25.02.2009 which was upheld by the Commissioner, Gurgaon as well as Financial Commissioner, Haryana.

Learned counsel for the petitioner submits that the authorities below have committed a grave error in rejecting the claim of the petitioner.

He submits petitioner is a matriculate and scored 67% marks while respondent No.4-Vikram Singh is not even a middle class pass.

Petitioner was, thus, only suitable candidate for Kumar Ajay 2014.02.22 10:13 I attest to the accuracy and integrity of this document CWP No.1607 of 2012 2 appointment as Lambardar.

He submits that impugned orders are unsustainable.

Thus, they deserve to be set-aside.

It appears that 5 applications with regard to vacant post of Lambardar in village Khaleta, District Rewari were received by Assistant Collector Grade II, Rewari.

After following the due process, Assistant Collector Grade II, Rewari recommended the name of Satish Kumar son of Shri Subhash Chander as suitable candidate for the vacant post of Lambardar.

After considering the recommendation, Collector Rewari, vide his order dated 25.02.2009 found Vikram Singh (respondent No.4 herein) as fit candidate for the vacant post of Lambardar.

Aggrieved, petitioner preferred an appeal before the Commissioner, Gurgaon but the same was dismissed on the ground that appointment of Lambardar cannot be disturbed unless same suffers from any irregularity or perversity.

Revision was later preferred before the Financial Commissioner, Haryana which met the same fate.

I find no infirmity with the orders passed.

It is well settled that once an appointment of Lambardar is made by the Collector, same cannot be interfered with unless there is some grave illegality or perversity.

The documents placed on record alongwith miscellaneous application cannot help the case of petitioner.

He has not been able to show any defect with the orders passed by the authorities.

No ground has been made out for interference in writ jurisdiction.

Same is without any merit and is hereby dismissed.
