This order will dispose of CWP No.5814 and 21880 of 2011 as common questions of law and facts are involved therein.
The grievance of the petitioners in the present petitions is that they are working in the schools managed by the Department of Local Government.
In terms of policy decision notified on 3.3.2006, 3,949 Government Primary Schools were transferred to the Department of Rural Development & Panchayat and 232 Government Primary Schools were transferred to the Department of Local Government.
In these schools, the teachers were appointed by the departments concerned.
The petitioners were appointed in the schools run by the Department of Local Government, Punjab.
A public notice was issued by the Director, Public Instructions (Elementary Education).Punjab, inviting applications from the ETT Teachers working in the schools run by the Zila Parishads in the Punjab Rural Development and Panchayat Department, to fill up the posts of ETT Teachers lying vacant in the Education Department by way of transfer.

They should have also been given fair chance of appointment in the Education Department on transfer basis.
Today reply by way of short affidavit of Darshan Kaur, Director, Public Instructions (EE).Punjab, dated 10.2.2014, has been filed in court.
The same is taken on record.
It is stated therein that in terms of decision taken by the Government, the teachers working in the schools managed by Urban Local Bodies will also be absorbed as per requirement in the respective districts.
Learned counsel for the petitioners submitted that in view of the aforesaid decision taken by the State, prayer made in the present petition has been rendered infructuous.
Ordered accordingly.
