ORDER

SHEET CS No.262 of 2001 IN THE HIGH COURT AT CALCUTTA Ordinary Original Civil Jurisdiction ORIGINAL SIDE SHYAMA ENCLAVE PVT.LTD.Versus SANJIB KR.

ROY & ORS.BEFORE: The Hon'ble JUSTICE SOUMEN SEN Date : 18th February, 2014.

Appearance: Mr.Joy Saha, Adv.The Court: The affidavit of service shows that the defendant no.2(i) could not be served as the rooms were found to be locked.

In view thereof, leave is given to the plaintiff to cause substituted service.

The draft notice shall be placed before the learned Registrar, Original Side within a week for settlement.

The notice shall be published once in “The Statesman” and once in “Bishwamitra”.

The plaintiff shall file the affidavit of service on the next date of hearing.

The notice must specify the returnable date of the suit.

The suit shall appear eight weeks hence.

An oral prayer is made on behalf of the defendant no.2(b) for extension of time to file written statement.

The written statement shall be filed within three weeks from date upon payment of cost of 100 GMs.to be paid within a week from date as a condition precedent for such extension.

The non-appearing defendants are given the same opportunity to file the written statements on the same condition as has been extended to the defendant no.2(b).It is made clear that in the event no such written statement is filed by the said defendants within the extended period no further opportunity would be given to the said defendants to contest the suit and they shall forfeit the right to file the written statement.

The learned Advocate-on-Record of the plaintiff is directed to communicate this order to the defendants who had appeared on 7th January, 2014, namely, 2(c).2(d).2(e).2(j).2(k).2(l).2(o).2(w).2(z) & 2(z)(ii).Registrar, Original Side and all parties concerned are to act on a signed photocopy of this order on the usual undertakings.
