Ms.SiMs.Dhir Malhotra, DAG, Punjab....RAM CHAND GUPTA, J.(Oral) The present petition filed under Section 438 Cr.P.C.is for grant of anticipatory bail to the petitioner in case FIR No.40, dated 20.2.2013, under Sections 36(1)(3) of the Punjab Apartment and Property Regulation Act, 1995 and Section 420 IPC, registered at Police Station Fatehgarh Sahib.

I have heard learned counsel for the parties and have gone through the whole record carefully.

Coordinate Bench of this Court while issuing notice of motion on 22.5.2013, passed the following order: “Petitioner is alleged to have violated the provisions of Punjab Apartment and Property Regulations Act, 1995.

Notice of motion for July 17, 2013.

Meanwhile, an interim direction is issued that the petitioner will join investigation on June 1, 2013 and in case of his doing so, he will be released on interim bail to the satisfaction of the arresting officer.”

It has been stated by learned counsel for the petitioner that pursuant to the said order, the petitioner has already joined the investigation.

There are no allegations on behalf of the State that petitioner is likely to abscond or that he is likely to dissuade the witnesses from deposing true facts in the Court, if released on bail.

In view of these facts and without expressing any opinion on the merits of the case, order dated 22.5.2013, granting interim bail to petitioner-Kawaljit Singh is, hereby made absolute subject to the compliance of conditions contained in Section 438(2) Cr.P.C.The present petition stands disposed of accordingly.
