This petition has been filed under Section 438 Cr.P.C.for grant of anticipatory bail to the petitioner in case FIR No.231 dated 12.11.2013 under Sections 420, 465, 467, 468, 471 and 120-B IPC and under Section 24 of the Emigration Act, registered at Police Station Division No.7 (Vardhman) City Ludhiana.
Learned counsel for the petitioner contended that petitioner has been falsely implicated in the present case.
He has not received any money, though there is allegation that he has also received ` 2 lacs.
I have gone through the record and have heard learned counsel for the petitioner.
From the record, I find that the petitioner is named in the FIR.
The perusal of the FIR, which is detailed one, shows the active Gulati Vineet 2014.02.17 10:13 I attest to the accuracy and integrity of this document Chandigarh CRM No.M-4682 of 2014 -2- participation of the petitioner in the commission of the offence.
The allegations are that a huge amount has been taken by the petitioner and co-accused for sending the complainant to Canada etc.There is specific allegation that the present petitioner has received ` 2 lacs and the remaining amount is stated to have been given to other Co.accused.
Keeping in view the facts and circumstances of the present case, nature and gravity of the offence and in view of the fact that custodial interrogation of the petitioner is required, therefore, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail.
Therefore, finding no merit, the present petition is dismissed.
