Petitioner Parvesh alias Ramal has preferred this petition under Section 438 Cr.P.C., seeking anticipatory bail in case FIR No.868 dated 24.10.2013, registered at Police Station City Jind, District Jind, under Sections 420, 406, 506 IPC.
Learned counsel for the petitioner contended that the petitioner has joined the investigation and false case has been planted upon him.
On the other hand, learned State counsel opposed the bail application and contended that the money has not been got recovered during investigation joined by the petitioner.
I have heard learned counsel for the petitioner and learned State counsel and have gone through the record.
From the record, I find that as per prosecution version, the allegations are that at the asking of the petitioner, the complainant gave money to the petitioner and his companion without getting executed any pronote etc.Now the complainant is saying that they are not returning the money.
The case looks like of civil nature.
Otherwise, the petitioner has joined the investigation.
His custodial interrogation is not required.
No useful purpose will be served by sending the petitioner to custody.
Therefore, keeping in view the facts and circumstances of the present case and without discussing the facts of the case in minute details and without expressing any opinion on the merits of the case, the present petition is accepted and the order dated 13.12.2013, passed by this Court, granting interim bail to the petitioner, is made absolute.
