Judgment:
HON'BLE Ms.S.USHA, TECHNICAL MEMBER:
Miscellaneous petition filed by the applicant in the original rectification application to revoke the vakalath of the earlier counsel on record who filed the rectification application.
2. The earlier counsel filed the main rectification application and subsequently the applicant had changed the counsel, but consent from the earlier counsel was not obtained. Hence the applicant had taken out this miscellaneous petition for revocation of the vakalath.
3. Notice in the miscellaneous petition was served on the earlier counsel and on receipt of the same, the counsel had written to this Appellate Board giving his consent for the change.
4. The matter was posted for hearing before the Bench. The counsel for the first respondent submitted that they had no objection in allowing the miscellaneous petition.
5. As the earlier counsel has written to the Board vide letter dated 02.01.2009 and 07.04.2009, miscellaneous petition does not survive. The miscellaneous petition is therefore disposed of.
