honble z.s.negi, chairman: when the matter was called today neither the applicant nor the respondent is present. therefore, the matter is passed over. 2. when the matter is called again after the end of the cases listed for today, no representative for applicant and respondent are present. a perusal of records reveal that form c sent to the respondent no. 2 has neither returned undelivered nor the a.d. card received. the applicant, therefore, filed miscellaneous petition no.56/2009 for allowing the applicant to effect service on respondent no. 2 by publishing the notice of hearing in a daily newspaper. the hearing notice for todays hearing has been received by the both the applicant as well as respondent. since the applicant is absent, we dismiss the miscellaneous petition. list the rectification application for hearing after completion of pleadings.

When the matter was called today neither the applicant nor the respondent is present. Therefore, the matter is passed over.

2. When the matter is called again after the end of the cases listed for today, no representative for applicant and respondent are present. A perusal of records reveal that Form C sent to the respondent No. 2 has neither returned undelivered nor the A.D. card received. The applicant, therefore, filed miscellaneous petition No.56/2009 for allowing the applicant to effect service on respondent No. 2 by publishing the notice of hearing in a daily newspaper. The hearing notice for todays hearing has been received by the both the applicant as well as respondent. Since the applicant is absent, we dismiss the miscellaneous petition. List the rectification application for hearing after completion of pleadings.
