Chakraborty, Advocate : Ms.Debjani Roy, Advocate For State The Court : After hearing the learned Advocates for the respective parties and after going through the petition I am of the view that this writ petition should be disposed of on Affidavits.

Let Affidavit-in-opposition be filed within after reopening of Court after the Christmas vacation.

two weeks Let Affidavit-in- reply thereto, if any, be filed within a week thereafter.

Let this matter appear in the supplementary list for hearing three weeks after reopening of Court after the Christmas vacation.

The petitioner has alleged that still now there are about five seats lying vacant in the concerned subject in the University of Burdwan.

Mr.Achinta Banerjee, learned Advocate appearing for the University Authorities has confirmed that.

But he submits that the couRs.had started in the month of September 2013 and it will be very difficult for the petitioner to complete the fiRs.semester course.

He further submits that the internal examination for the fiRs.semester is scheduled to start on and from January 22, 2014 and the fiRs.semester examination itself will start from February 2014.

Therefore, the University submits, it will be very difficult for the concerned candidate to complete the couRs.and to keep the attendance if the petitioner is admitted belatedly.

Mr.Arefin on instruction submits that the petitioner might still be allowed to attend the classes.

In such view of it, the University is directed to admit the petitioner as a student of the concerned couRs.provided the petitioner presents himself for such admission within a week from today.

It is made clear that such admission shall not create any equity in favour of the petitioner and shall not confer any right upon the petitioner to appear at any examination in violation of the University Rules.

The authorities are directed to act on the written communication by the learned Advocates without insisting on the certified copy of the order.
