JASWANT SINGH, J (ORAL) Petitioner wife has filed the present transfer application under Section 24 CPC for the transfer of divorce proceedings filed by the respondent-husband titled Ajit Singh versus Harjit Kaur from the Court of learned Addl.
District Judge, Patiala to the Court of competent jurisdiction at SAS Nagar, Mohali.
It is stated that the marriage between the parties was solemnized on 15.5.2011 at Dera Bassi, District Mohali.
The parties cohabited as husband and wife at Nabha.
Due to matrimonial dispute, it is alleged that the petitioner-wife is stated to be residing separately at her parental home at Dera Bassi, District Mohali.
Thereafter, the respondent husband filed the divorce petition, which, as noticed above, is pending in the Court of learned Addl.
District Judge, Patiala.
At the time of hearing, learned counsel for the respondent- husband very fairly states that he has no objection if the aforesaid T.A.No.283 of 2013 (O&M) #2# divorce proceedings are ordered to be transferred from the court at Patiala to a court of competent jurisdiction at SAS Nagar, Mohali.
In view of the aforesaid agreed stand, the present petition is allowed, the divorce proceedings titled titled Ajit Singh versus Harjit Kaur from the Court of learned Addl.
District Judge, Patiala is ordered to be withdrawn and transferred to the District Courts, SAS Nagar Mohali for disposal in accordance with law from the stage of withdrawal.
