.....17 of the c.l.a. act, in connection with tundi p.s. case no. 59 of 2009 corresponding to g.r. no. 2610 of 2009, s.t. no. 397 of 2012. the case relates to murder of brother of the informant and the informant happens to be the eyewitness to the occurrence. the fir was lodged against six to seven unknown extremists. the impugned order shows that other co-accused persons who had faced the trial have been acquitted after trial. in the facts of this case, i am inclined to enlarge the petitioner, shiva turi, on bail. accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned 2nd addl. sessions judge, dhanbad, in connection with s.t. no. 397 of 2012, arising out of tundi p.s. case no. 59 of 2009 corresponding to g.r. no. 2610 of 2009. MISHRA ------ For the Petitioner : Mr. Niranjan Singh, Advocate For the State : A.P.P. -------- 7/ 16.09.2013 Heard learned counsel for the petitioner and learned A.P.P. for the Prosecution. The petitioner has been made accused for the offences under Sections 147, 148, 149, 302, 120B of the Indian Penal Code, Section 27 of the Arms Act and Section 17 of the C.L.A. Act, in connection with Tundi P.S. Case No. 59 of 2009 corresponding to G.R. No. 2610 of 2009, S.T. No. 397 of 2012. The case relates to murder of brother of the informant and the informant happens to be the eyewitness to the occurrence. The FIR was lodged against six to seven unknown extremists. The impugned order shows that other co-accused persons who had faced the trial have been acquitted after trial. In the facts of this case, I am inclined to enlarge the petitioner, Shiva Turi, on bail. Accordingly, the petitioner, named above, is directed to be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand), with two sureties of the like amount each, to the satisfaction of learned 2nd Addl.
