Ritu Bahri, J This petition is for quashing of complaint No.125-2/2010 dated 12.5.2010 under Sections 12/18/19/20/22/23 of the Protection of Women from Domestic Violence Act, 2005 (Annexure P-4) and the summoning order dated 12.5.2010 (Annexure P-8).The petitioner got married to respondent No.2 on 26.4.2002 at Moradabad (UP) according to Hindu rites and rituals.
They lived together and separated on 8.2.2010.
Respondent No.2 gave birth to a son on 30.7.2003 at Moradabad.
Respondent No.2 has filed a petition under Section 13 of the Hindu Marriage Act, for dissolution of marriage.
The petitioner did not contest this petition and subsequently, divorce was granted on 16.5.2013.
The parties were relegated to Mediation & Conciliation Centre vide order dated 27.2.2013 passed by this Court.
As per the report of the Mediation & Conciliation Centre, the matter has been amicably settled between the parties.
The petitioner has agreed to pay a sum of Rs.40.00 lacs to respondent No.2.
Parties are present in the Court and they have been identified by Crl.

A draft of Rs.40.00 lacs has been handed over to respondent No.2 in Court today.
The petitioner and respondent No.2 have filed their respective affidavits in Court today.
The same are taken on record.
As per the affidavit of the petitioner, he has returned the passport of respondent No.2-Sunaina Arora and master Avi Arora along with draft of Rs.40.00 lacs bearing draft No.323991, dated 23.8.2013, issued by Allahabad Bank, Moradabad, and her PAN card, in Court today.
He also deposed that he shall withdraw the custody case filed by him for his son Avi Arora, pending in the Court at SiRs.on the next date of hearing i.e.21.9.2013.
As per the affidavit given by respondent No.2, she has received a banker's cheque of Rs.40.00 lacs, and her passport as well as her PAN card.
She further undertakes to withdraw the case/cases filed by her against the petitioner in the Court at SiRs.on the date already fixed i.e.21.9.2013 or before 30.9.2013.
In view of the affidavits filed by both the parties, since all the conditions of compromise have not been settled, complaint No.125-2/2010 dated 12.5.2010 (Annexure P-4) and the summoning order dated 12.5.2010 (Annexure P-8) are hereby quashed.
Petition is disposed of.
