(ORAL) 1.
The writ petition is for a prayer for regularization and for grant of minimum of the scales during the time when the petitioner was employed on contract basis.
Learned counsel appearing for the State submits that a policy had been made in the year 2003 and he was regularized and put on regular scales attached to the post from 01.10.2003.
When the petitioner has accepted an employment on particular terms and has continued as such, a prayer for being paid the salary on the minimum scales applicable to regular employee does not arise now.
There have been, however, instances where such consideration has been done but they were only in situations where regularization itself was not possible and the issue came up before Court for consideration of whether the contractual employees should be paid at least minimum of scales applicable for regular employees.
Where a Kamboj Pankaj Kumar 2013.09.06 12:19 I attest to the accuracy and integrity of this document Chandigarh C.W.P.No.14582 of 2002 -2- person has come by benefit of regularization, the question of redefining the terms for the period during contract and securing to him the benefit of minimum scales applicable for regular employee does not arise.”
2. The contention of the State as regards the petitioner securing a regularization in the posts is taken on record and the writ petition does not require any further relief to be granted to the petitioner.
The writ petition is disposed of.
