1. Prayer in this petition, filed under Section 438, Cr.P.C., is for grant of anticipatory bail to the petitioner, Yadwinder Pal Singh, son of Kanwar Singh, resident of House No.4391, Gali No.3, Ranjitpura, Amritsar, who has been booked for having committed the offences punishable under Sections 420, 465, 466, 468 and 471, IPC, in a case arising out of FIR No.158, dated 16.10.2011, registered at Police Station, 'E' Division, Amritsar.
2. Learned counsel repeatedly contended that it was mentioned in the FIR that the complainant, N.S. Bhinder, had operated the bank locker in the year 2010, therefore, no case is made out against the petitioner. He further submitted that the complainant and his family was residing in the foreign country and there was a dispute amongst the family members with CRM-M No.40420 of 2012 (O&M) 2 regard to the property and, as such, the petitioner has falsely been implicated.
3. I have heard learned counsel for the parties and perused the police file.
4. From the perusal of the FIR, it is no where found mentioned that the complainant, N.S. Bhinder, had not operated the bank locker. Learned counsel for the petitioner tried to mislead the Court by making wrong submissions. The facts reveal that the petitioner presented the forged documents before the bank and misrepresented that he had lost the key and thereafter got the locker unlocked and with the help of Kuldip Kaur took away the material lying there. Therefore, the allegations being serious ones, no case for grant of anticipatory bail is made out.

Since the petitioner had tried to mislead the Court by mis-stating the facts, therefore, he is burdened with costs of `5,000/-, which shall be deposited with the Punjab Legal Services Authority, Chandigarh, within one month of passing of this order. In case, the costs is not deposited within the stipulated period, the Registry of this Court shall initiate proceedings, in accordance with law, for recovery of the costs imposed.
