( Oral ) One Dharma Ram son of Shri Surta Mal was allotted plot No.12, situated at Market Committee, Behal, in public auction on 13.11.1976.
From Dharma Ram, the said plot was purchased by the father of the petitioner vide registered sale deed dated 25.7.1994 (Annexure P-2).Thereafter, father of the petitioner expired on 5.10.2010.
Earlier to that, regarding the aforesaid plot, he had executed a registered Will dated 25.1.2010 (Annexure P-4) in favour of the petitioner.
On the basis of the said Will, on 27.5.2011, the petitioner moved an application (Annexure P-5) to the Secretary, Market Committee, Behal (respondent No.4 herein).for transfer of the said plot in the records of the Market Committee in his favour.
It is the case of the petitioner that when no decision was taken on the CWP No.280 of 2013 -2- said application for more than one year, he served a legal notice dated 14.9.2012 upon the respondents, copy of which has been annexed with the petition as Annexure P-6, but till date, no action has been taken even on the said legal notice.
After hearing learned counsel for the petitioner, without issuing notice of motion to the respondents, as it will un-necessary delay the matter, we deem it appropriate to dispose of this writ petition with a direction to respondent No.4 to consider the application dated 27.5.2011 (Annexure P-5) moved by the petitioner for transfer of the said plot in the records of the Market Committee in his favour, in accordance with law, expeditiously, and preferably within a period of three months, by passing a speaking order.
