(ORAL) Petitioners have approached this Court for issuance of a writ of mandamus directing respondents to extend the petitioners the benefit, which has been granted by this Court in CWP No.2208 of 1989 titled as Lekh Raj Khera and others versus State of Punjab and another, decided on 24.03.2009 which entitles the petitioners the benefit of pay revision w.e.f.01.11.1971 instead of 16.07.1975 along with the consequential benefits.

Claiming the said benefit, the Union, of which the petitioners are membeRs.have submitted a representation dated CWP No.25973 o”

2. 05.07.2011 (Annexure P-8) to the Director, Public Instructions (Secondary Education).Punjab-respondent No.2.

Counsel for the petitioners contends that liberty may be granted to the petitioners to file a detailed representation to the Director, Public Instructions (Secondary Education).Punjab- respondent No.2 which representation shall be filed by the petitioners within a period of six weeks from today and the same may be directed to be considered and decided at an early date.

In the light of the statement made by the counsel for the petitioneRs.the present writ petition is disposed of with liberty to the petitioners to file a detailed representation to the Director, Public Instructions (Secondary Education).Punjab-respondent No.2.

If such a representation is made by the petitioners within a period of six weeks from today, the same shall be considered and decided by the said respondent within a further period of five months from the date of submission of such representation.

In case the claim of the petitioners is accepted, the consequential benefits, if any, be released them, in accordance with law, within a further period of two months.

Arrears shall be restricted to 38 months from the date of filing of the representation.

In case the claim of the petitioners is not to be accepted, a well-reasoned and speaking order be passed and conveyed to the petitioners forthwith.
