1. Prayer in this petition is for grant of regular bail to the petitioner, Nishant @ Nishu Taneja, son of Virender Kumar, resident of Kamalpuri Colony, Tehsil Jagadhri, District Yamunanagar, who has been booked for having committed the offences punishable under Sections 420, 489-A, 489-B and 489-C, IPC, in a case arising out of FIR No.163, dated 31.5.2012, registered at Police Station, Farkpur, District Yamunanagar.
2. Learned counsel contends that according to the allegations of the prosecution, 20 fake currency notes of the denomination of `100/- each were allegedly recovered from the petitioner on 31.5.2012. He further submits that after investigation, the charge-sheet has already been submitted and the case is not fixed for recording of the prosecution evidence, therefore, further incarceration of the petitioner is not worth.
3. Learned counsel for the State has opposed the prayer CRM-M No.38396 of 2012 (O&M) 2 for grant of bail to the petitioner. However, he submits that after investigation, the charge-sheet (report under Section 173, Cr.P.C.) has already been submitted, therefore, the petitioner is not required by the Investigating Agency.

5. The petitioner is behind the bars from 31.5.2012. He is neither required not involved in any other case. After completion of the investigation, the charge-sheet has already been submitted before the learned Court below.

Keeping in view the totality of the circumstances of the case, the period of incarceration suffered by the petitioner and the fact that it would take sufficient long time to conclude the trial, the present petition is allowed. The petitioner, Nishant @ Nishu Taneja, son of Virender Kumar, resident of Kamalpuri Colony, Tehsil Jagadhri, District Yamunanagar, is ordered to be released on bail in this case during the pendency of the trial, subject to his furnishing the bail bonds to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Jagadhri at Yamunanagar.
