******* VIJENDER SINGH MALIK, J.(ORAL) Darshna, the petitioner seeks pre-arrest bail in a case registered by way of FIR No.138 dated 24.09.2012 at Police Station City, Phagwara, District Kapurthala, for an offence punishable under sections 406 and 498-A of Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a widowed mother-in-law of Vidhu Kapur, the complainant.
According to him, the dispute was regarding job of Vidhu Kapur between her and her husband, Hemant Chaudhry.
He referred me to Annexure P-2, the compromise which was effected between Hemant Chaudhry and Vidhu Kapur under which she was to start living at Mohali with her husband Hemant Chaudhry and then to decide whether to continue in the job or give Harish Kumar 2013.08.21 16:04 CRM not M-32899 of 2012 -2- up the job.
According to him, there is no specific allegation against the petitioner in the FIR.
He further submits that the petitioner has joined the investigation and has cooperated with the same.
Learned State counsel, on the other hand, submits that there are specific allegations against the petitioner.
According to him, the petitioner has harassed the complainant in connection with demand of dowry.
He, however, admits that the petitioner has joined the investigation.
I have gone through the contents of the FIR which is a very short document.
It does not contain anything specific against the petitioner.
The allegations against the petitioner are general in nature.
Looking to the fact that the dispute is between the complainant and her husband as also that the petitioner has joined the investigation, I find the petitioner to be entitled to pre-arrest bail.
Consequently, the petition is allowed and order dated 17.10.2012 granting interim anticipatory bail to the petitioner is made absolute.
