( Oral ) The petitioner has filed the instant petition for issuing direction to the respondents to allot him plot under the oustees category.
It is the case of the petitioner that he was co-sharer in the land measuring 8 kanals 6 marlas, situated within the revenue estate of village Dumawas, Tehsil and District Rewari, as depicted in jamabandi for the year 1991-92, copy of which has been annexed with the petition as Annexure P1.
Vide notification dated 30.3.1990 issued under Section 4 of the Land Acquisition Act, 1894, part of the aforesaid land was acquired for development of residential and commercial area, whereas the remaining part of the aforesaid land was acquired vide award dated 18.12.2002 for development of residential, commercial and road in Sector 4, Rewari.
It is Dass Narotam 2013.09.19 14:03 I attest to the accuracy and integrity of this document CWP No.20607 of 2013 -2- the further case of the petitioner that in spite of the requests made by him, the respondents did not consider his claim for allotment of plot under the oustee policy of the State Government.
In this regard, he submitted representation dated 18.10.2012 to the Estate Officer, HUDA, Gurgaon (respondent No.3 herein).copy of which is available on record as Annexure P-8, but till date the same has not been considered and decided.
After hearing learned counsel for the petitioner, without issuing notice of motion as it will un-necessary delay the matter, we dispose of this petition with a direction to respondent No.3 to consider and decide the aforesaid representation dated 18.10.2012, in accordance with law by passing a speaking order, expeditiously, preferably within a period of three months.
