Crl.M.not M-24887 of 2013(O&M) Date of Decision: August 5, 2013 Rajender Kumar @ Rajender Singh Dahiya .....Petitioner v.
State of Haryana and another .....Respondents CORAM: HON'BLE MR.JUSTICE RAM CHAND GUPTA Present: Mr.Aman Pal, Advocate for the petitioner....RAM CHAND GUPTA, J.(Oral) The present petition filed under Section 439(2) Cr.P.C.is for cancellation of anticipatory bail granted by this Court to respondent no.2 vide order dated 13.3.2013, Annexure P1, in case FIR No.591, dated 17.10.2012, under Sections 420, 467, 468, 471, 120-B IPC, registered at Police Station Gurgaon City, District Gurgaon.
I have heard learned counsel for the petitioner and have gone through the whole record carefully, including the impugned order passed by this Court.
Briefly stated, respondent no.2 is wife of the petitioner.
The present FIR was a result of matrimonial discord between the petitioner and respondent no.2.
There was also dispute regarding ancestral property, part of which was allegedly sold by the petitioner.
Bail was granted by this Court to respondent no.2 being a lady vide order dated 13.3.2013 passed by this Court.
The only ground taken by learned counsel for the petitioner for cancellation of bail already granted to respondent no.2 is that a joint account was opened in the name of petitioner and respondent no.2 and as per report FSL, the same does not contain signatures of the present petitioner.
In this case investigation already completed and challan filed.
Bail application of respondent no.2 was not opposed on behalf of the State.
Meenu 2013.08.05 17:00 I attest to the accuracy and integrity of this document chandigarh Crl.M.not M-24887 of 2013(O&M) -2- Hence, in view of these facts, no case for cancellation of bail already granted to respondent no.2 by this Court is made out.
Without expressing any opinion on the merits of the case, the present petition filed by petitioner-Rajender Kumar @ Rajender Singh Dahiya for cancellation of bail to respondent no.2 is, hereby, dismissed being devoid of any merit.
