***** AUGUSTINE GEORGE MASIH, J.(ORAL) Petitioner has approached this Court with a prayer that the benefit of the judgment passed by this Court in Civil Writ Petition No.10454 of 2011 (Bhim Sain and others Versus State of Punjab and another).decided on 2.6.2011 has not been granted to him till date, according to which he is entitled to the grant of the regular pay scale for the post of Headmaster as he has worked on the said post as an officiating Headmaster for the period from 3.8.2006 to 4.9.2008 at Government High School, Garh Padhana, District S.B.S.Nagar.
Asserting this right, petitioner has served a legal notice dated 20.4.2013 (Annexure P-3) upon the Director, Public Instructions (Secondary Education).Punjab-respondent No.2, which Civil Writ Petition No.12096 of 2013 {2} has not been responded to till date.
Counsel contends that the petitioner, at this stage, would be satisfied if a direction is issued to the Director, Public Instructions (Secondary Education).Punjab-respondent No.2 to consider and decide the legal notice dated 20.4.2013 (Annexure P-3) served by the petitioner, within some specified time.
In view of the statement made by the counsel for the petitioner and without going into the merit of the case or commenting thereon, the present writ petition is disposed of with a direction to the Director, Public Instructions (Secondary Education).Punjab- respondent No.2 to consider and decide the legal notice dated 20.4.2013 (Annexure P-3) within a period of four months from the date of receipt of certified copy of this order.
In case the claim of the petitioner is accepted, the consequential benefits, if any, be released to him, in accordance with law, within a further period of two months.
In case the claim of the petitioner is not to be accepted, then a well reasoned and speaking order be passed and conveyed to the petitioner forthwith.
