Prayer in this petition is for grant of anticipatory bail to the petitioner, Baldev Singh, son of Kartar Singh, resident of Village Jaura Chhitran, Tehsil and District Gurdaspur, who has been booked for having committed the offences punishable under Sections 120-B, 381 and 408, IPC, in a case arising out of FIR No.13, dated 05.02.2013, registered at Police Station, E-Division, Amritsar.
Learned counsel contends that the petitioner was posted at Sr.Darbar Sahib, Amritsar, as a security guard.
He had nothing to do with the nefarious activities alleged to have been committed by his Co.accused; that the alleged stolen amount fell on the ground when Manpreet and Kuljeet were carrying it from the strong-room of Sr.Darbar Sahib; and that in compliance of the order dated 08.04.2013 passed by this Court, the petitioner did join the investigation and fully co-operated with the Investigating Agency.
Learned counsel for the State, on instructions from ASI Jujhar Singh, Police Station, E-Division, Amritsar, very fairly concedes Criminal Misc.
not M-11239 of 2013 (O&M) ..2.that in compliance of the order dated 08.04.2013 passed by this Court, the petitioner has joined the investigation and fully co-operated with the Investigating Agency, therefore, his further custodial interrogation is not required in this case.
Keeping in view the facts and circumstances of the case, the present petition is allowed and the order dated 08.04.2013 passed by this Court whereby the ad-interim anticipatory bail was granted to the petitioner, is made absolute.
The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2).Cr.P.C.July 04, 2013 (Naresh Kumar Sanghi) seema Judge
