(ORAL) Petitioners assert that they were appointed during the period 1986-1998 as Malis.
They have been serving continuously the respondent- Department, but their services have not been regularized, despite they being eligible for regularization, as per various Haryana Government Instructions, issued from time to time.
Some of the petitioners are eligible and would be covered by the policy decision of the Government of Haryana, dated 7.3.1996 (Annexure-P-1).whereas all of them are eligible for regularization under the policy dated 1.10.2003 (Annexure-P-2) and policy dated 29.7.2011 (Annexure-P-5).Respondents, when did not grant them the benefit which they were entitled to as per these instructions, submitted representations and approached them personally also, but that also did not result in any benefit to them.
Faced with this situation, petitioners served legal notice dated 31.8.2012 (Annexure-P-7).upon the respondents which also has not been decided till date.
Counsel for the petitioners submits that the petitioneRs.at this stage, would be satisfied if a direction is issued to the Divisional Forest CWP No.22693 of 2012 -2- Officer (Territorial).Faridabad-respondent No.3 to consider and decide the legal notice, served by the petitioneRs.within some specified time.
Without going into the merits of the case or commenting thereon, this petition is disposed of with direction to the Divisional Forest Officer (Territorial).Faridabad-respondent No.3 to consider and decide the legal notice dated 31.8.2012 (Annexure-P-7).served by the petitioneRs.within a period of three months from the date of the receipt of the certified copy of this order.
The decision so taken be conveyed to the petitioners forthwith.
