Petitioner has filed this petition under Article 226 of Constitution of India read with Section 3 of Punjab Good Conduct Prisoner Temporary Release Act, 1988 for issuing writ in the nature of mandamus directing the respondent to grant parole to the petitioner for a period of six weeks.
Learned counsel for the petitioner has submitted that the marriage of the daughter of the petitioner is fixed for 28.04.2013.
Petitioner be allowed six weeks parole to enable him to make arrangements for the wedding of his daughter.
Learned State counsel who is assisted by Assistant Superintendent, Headquarters Gurpal Singh has admitted the factum of marriage of the daughter of the petitioner.
In reply submitted by the State, certificate of the Sarpanch has also been attached wherein marriage of the daughter of the petitioner is stated to be fixed for 28.04.2013 and the residents of the area had no objection if the petitioner was ordered to be released on parole.
The Station House Officer, Police Station, Nissing has also reported after verification, that it was found that marriage of the daughter of the petitioner is fixed for 28.04.2013.
Keeping in view the fact that marriage of the daughter of the petitioner has to take place on 28.04.2013, this petition is allowed.
Petitioner be released on parole to enable him to attend the marriage of his daughter subject to his furnishing requisite bonds in this regard.
Petitioner is directed to surrender before the jail authorities on 01.05.2013 at 10.00 a.m.Copy of this order be given to the learned counsel for the petitioner under the signatures of the Court Secretary.
