Petitioner is working as a Panchayat Secretary in Gram Panchayat Tuniya in Janpad Panchayat Jabalpur and by the impugned order dated 13.7.2012, she has been transferred to Gram Panchayat Saliwada Devdwar in the same Janpad Panchayat-Jabalpur.
Challenge to the order of transfer is made mainly on the grounds of personal inconveniences due to her ailment and various other reasons.
A caveat application has been filed by the Chief Executive Officer, Zila Panchayat, Jabalpur and it is pointed out by the said authority that the transfer has been effected in accordance with transfer policy and, therefore, interference is not warranted.
Having heard learned counsel for the parties, it is clear that the transfer in question is not challenged on the grounds of statutory rule of regulation being violated, not is any mala-fide made out from the material available on record.
Merely on the ground of personal Smt.
Sudha Nair versus State & ORS.inconveniences of the petitioner, judicial review of an administrative order of transfer is not permissible.
That being so, as the representation of the petitioner is pending before the competent authority, the said authority is directed to decide the representation of the petitioner in accordance with law within a period of four weeks.
With the aforesaid, petition stands disposed of.
