The petitioner has filed this petition being aggrieved by the order dated 29-1-2013 by which the petitioner's selection and inclusion in the select list of the candidates to be appointed as Guruji has been cancelled on the basis of an enquiry in which it has been found that the petitioner was not continuing to work in the Non-Formal Education Centre, Hausena.
It is submitted by the learned counsel for the petitioner that the enquiry has been conducted behind the back of the petitioner and the documents regarding payments made to the petitioner up to 28-9-2000 have not been considered.
It is submitted that on 7-2-2013 the petitioner has submitted a representation before the authorities which is pending decision but without taking cognizance of the same the impugned order has been passed.
Having heard the learned counsel for the parties looking to the fact that the petitioner's representation against the impugned order is pending before the authorities, the petition filed by the petitioner is disposed of with a direction to the effect that in case the petitioner furnishes a copy of the order passed today and a copy of the petition before the respondent/authorities within fifteen days of obtaining the same, the concerned authority shall consider and decide the petitioner's aforesaid representation by passing a reasoned order in accordance with law expeditiously preferably within a period of three months thereafter.
In case the petitioner is found to be entitled to be appointed on the aforesaid post, consequential order shall be passed by the authority concerned.
Till then operation of the impugned order shall be kept in abeyance.
However, it is made clear that this court has not expressed any opinion on the merits of the case and therefore the authority would be at liberty to examine the matter keeping all facts and facets into consideration and thereafter either accept or reject the representation by passing a reasoned order.
With the aforesaid directions, the petition filed by the petitioner stands disposed of.
