.....panel lawyer submits that if the petitioner submits a representation, the same shall be considered in the light of the order passed on 7.11.2012 by a bench of this court. in view of the submissions made by the learned counsel for the parties and in the facts of the case, order dated 13.8.2010 is hereby quashed. in case the petitioner submits a fresh representation within ten days from the date of receipt of a certified copy of the order passed today, the competent authority shall consider and decide the representation submitted by the petitioner by passing a speaking order within a period of six weeks from the date of receipt of such representation in the light of orders dated 7.11.2012 by a bench of this court and order dated 19.2.2008 passed by a division bench of this court in the case of sandeep kumar richhariya versus state of mp and others in w.a.no.1880/07. it is made clear that this court has not expressed any opinion on the merits of the case. accordingly, the writ petition filed by the petitioner stands disposed of. c.c.as per rules. Heard.

In this writ petition, the petitioner interalia seeks quashment of order dated 13.08.2010 by which the representation of the petitioner for appointment on the post of lecturer in building construction has been rejected.

The petitioner also seeks a direction to the respondent to award him 35 marks as directed by a Division Bench of this court in the case of Sandeep Kumar Richhariya (W.A.No.1880/07).The learned counsel for the petitioner submits that the controveRs.involved in the instant writ petition is squarely covered by order dated 07.11.2012 passed by a bench of this court in W.P.No.18828/12.

On the other hand, the learned panel lawyer submits that if the petitioner submits a representation, the same shall be considered in the light of the order passed on 7.11.2012 by a bench of this court.

In view of the submissions made by the learned counsel for the parties and in the facts of the case, order dated 13.8.2010 is hereby quashed.
