This is the fiRs.application filed by applicants under Section 439 of the Cr.P.C for grant of bail.
The applicants have been arrested on 5/10/12 in connection with Crime No.1041/12 registered at P.S.Kotwali, District Chhindwara for the offence punishable under sections 304-B, 498/34 of IPC and section 3/ 4 of the Dowry Prohibition Act.
Learned counsel for the applicants submits that applicants have been falsely implicated in the case.
Applicant no.1 Ravindra is brother-in-law and applicant no.2 Smt.
Leelabai is mother-in-law of deceased Pinki.
It is further submitted that applicant no.2, mother-in-law is suffering from the cancer and she requires the treatment immediately.
In support of his contention, he filed the number of documents of Superspecialty Blood & Cancer Hospital.
It is submitted that there is only general and omnibus allegation made against the applicants in regard to commit cruelty on deceased in relation to demand of dowry.
Trial would take considerable time to be disposed of finally therefore, he prays for bail to the applicants.
Learned counsel for the State opposes the application.
Considering the overall facts and circumstances of the case alongwith the nature of allegation made against these applicants and the fact that applicant no.2 is suffering from cancer and she requires immediate treatment, I am of the considered view that it is a fit case to release them on bail.
Therefore, without commenting on the merit of the case, this application is allowed and it is directed that applicants Ravind Karade and Smt.
Leelabai Karade shall be released on bail on their furnishing a personal bond in a sum of Rs.35,000/- (Rs.Thirty Five Thousand only) each with one surety in the like amount to the satisfaction of Committal Court/trial Court, for securing their presence before the said Court on all the dates of hearing fixed in this regard during trial.
