Heard.
The petitioner has filed this petition challenging the termination of contract dated 28.10.2011.
However, learned counsel for the petitioner submits that the petitioner seeks leave of this Court to take steps before the Arbitration Tribunal regarding the dispute.
Hence, relief is not pressed.
Prayer is allowed with liberty to take steps for arbitration.
The second challenge is regarding black listing of the petitioner by the order dated 28.10.2011.
The submission of the learned counsel for the petitioner is that the order has been passed without issuing any show cause notice and without giving any opportunity.
The denial of the said opportunity is accepted on behalf of the respondents.
It is settled law that black listing may cause several consequences and such an order cannot be passed without issuing show cause notice to the concerned person.
Hence, the said order to the extent of black listing the petitioner is set aside.
The rule is made absolute in above terMs.Needless to say that the respondents will be at liberty to take appropriate action in respect of black listing in accordance with law.
