Sarita Paraste versus State & ORS.W.P.No.13936/2012 03/09/2012 Shri Vijay Kumar Shukla, learned counsel for the petitioner.
Petitioner is working as an Assistant Teacher and the Charge of Superintendent of Girls Hostel Chargaon was given to the petitioner. By the impugned order, charge of Superintendent of Girls Hostel is given to Respondent No.5 and the petitioner is being transferred. Interalia contending that the transfer of the petitioner and taking over of charge from her is illegal and further contending that in a earlier writ petition, this Court had interfered into the matter and No. again petitioner is being transferred on same consideration, which was quashed in W.P.No.16651/2011, this writ petition is filed. It is seen from the records that earlier, when the petitioner was transferred in the year 2011 i.e. 29.8.2011, petitioner challenged this transfer in W.P.No..16651/2011.
Initially stay was granted by this court on 29.9.2011 and finally the writ petition was disposed of vide order AnnexureP6 on 13.12.2011 quashing the order of transfer dated 29.8.2011 and granting liberty to the respondents to pass fresh orders as per administrative requirement. The impugned order is now passed on the basis of the liberty granted to the respondents and, therefore, on the ground of breach of the earlier order passed by this Court, the impugned action cannot be interfered with. Smt.
Sarita Paraste versus State & ORS.The other grounds raised in this writ petition for challenging the order of transfer are the personal inconveniences of the petitioner and breach of transfer policy, on such grounds, as judicial review of an administrative order of transfer is not permissible, no case is made out for interference.
That apart, petitioner is substantively holding the post of Assistant Teacher and by the impugned order, she is only relegated to the said post after the temporary charge of Superintendent of Girls Hostel is taken by her. On such ground, interference is not called for.
Accordingly, finding no case made out for interference into the order of transfer on the grounds raised, the petition is dismissed.
