The petition seems to be arguable, hence admitted for final hearing.
Issue notice to respondents by both modes, i.e.by ordinary as well as RAD post.
Steps within seven clear working days.
Notice is made returnable within four weeks.
Shri Santosh Yadav, learned PL accepts notice for respondent no.6/State of M.P.So, there is no need to issue notice to respondent no.6.
Also heard on IA No.2923/13, an application for grant of stay.
Learned counsel for petitioners submits that an ex parte order was passed against the respondents and their application filed for setting aside an ex parte decree was dismissed by the trial Court, the lower appellate Court has erred in setting aside that order while allowing the application for setting aside the ex parte 2 decree.
He submits that if the further proceedings are not stayed then this petition will become futile.
Looking to the circumstances of the case, it is directed that further proceedings in CS No.7- A/10 pending before 1st Civil Judge, Class II, Dindori shall remain stayed till next date of hearing.
List the matter immediately after four weeks.
