.....451, 506(b) of the ipc. applicant has also sustained stab injuries. charge sheet has been filed. the applicant is in custody and trial would take considerable time to conclude, therefore, he be released on bail. learned counsel for state has opposed the application and submitted that injured eye witness ramesh sustained as many as 9 injuries and his brother kashiram has died in the incident. the applicant assaulted the deceased by using danda and human blood was also found on the same, as per fsl report, therefore, this application is liable to be dismissed. considering the overall facts and circumstances of the case, i do not find it a fit case to release the applicant on bail at this stage, application is hereby dismissed. M.Cr.C.No.1556/2013 13.3.2013 Shri Madan Singh, Advocate for the applicant.

This is the fiRs.bail application filed by the applicant under Section 439 of the Cr.P.C.for grant of bail.

The applicant is in custody since 1.11.2012 in connection with Crime No.340/2012 registered at P.S.Batiagarh, District Damoh for the offence punishable under sections 307, 147, 148, 149, 294, 323, 506(B) and 302 of the IPC.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case.

There is a counter case registered against the complainant party for the offence punishable under Sections 147, 148, 149, 294, 323, 324, 451, 506(B) of the IPC.

Applicant has also sustained stab injuries.

Charge sheet has been filed.

The applicant is in custody and trial would take considerable time to conclude, therefore, he be released on bail.

Learned counsel for State has opposed the application and submitted that injured eye witness Ramesh sustained as many as 9 injuries and his brother Kashiram has died in the incident.

The applicant assaulted the deceased by using Danda and human blood was also found on the same, as per FSL report, therefore, this application is liable to be dismissed.

Considering the overall facts and circumstances of the case, I do not find it a fit case to release the applicant on bail at this stage, application is hereby dismissed.
