Cr.Rev.232/2013 13.02.2013 Petitioner by Shri Deepak Pendharkar, Advocate.

Respondent No.2/State by Shri Alok Tapikar, P.L.This petition has been preferred against the judgment dated 23.1.2013 passed by Additional Sessions Judge, Amarpatan, District Satna in Criminal Appeal No.292/2010 affirming the judgment dated 6.9.2010 passed by Judicial Magistrate FiRs.Class, Amarpatan in Criminal Case No.905/2006 convicting the petitioner under Section 497 IPC and sentenced to two years R.I.and fine of Rs.500/-.

On perusal of the impugned judgment, it appears to be an arguable case, hence admitted for hearing.

Let a notice of this petition be issued to respondent No.1 by RAD.

Steps be taken within three working days.

Notice be made returnable within three weeks.

Let record of the courts below be called for.

On 18.4.2005, petitioner eloped with Ramkali wife of Ramnath for making physical relation with her and stayed with her for about fifteen days.

Aforesaid case was instituted on the basis of private complaint filed by the respondent husband against the petitioner.

Petitioner is in custody since last about three weeks and there appears no likelihood of hearing of this petition in near future.

Execution of jail sentence of the petitioner Ram Nihor Yadav @ Lalli Yadav shall remain suspended on his furnishing bond of Rs.5,000/- (Rupees Five Thousand Only) with surety in the like amount to the satisfaction of the trial court for his appearance before the Registry of this Court on 20th March, 2013 and on such other subsequent dates as may be fixed by the Registry in this regard.
