***** AUGUSTINE GEORGE MASIH, J.(ORAL) Petitioner has approached this Court with a prayer that he was initially appointed as Lecturer in Punjabi at Guru Gobind Singh College Gidderbaha on 03.08.1990.

He was confirmed on the said post vide order dated 12.03.1992 (Annexure P-2).The college was taken over by the Government on 22.10.1997 by renaming the College as Baba Sr.Chand Government College Sardargargh, District Bathinda and the services of the petitioner were also taken over as Lecturer in Punjabi.

not the post of Lecturer has been renamed as Assistant Professor.

He had been transferred from the Baba Sr.Chand Government College Sardargargh, District Bathinda to Government College for Education, Faridkot on 11.07.2003.

He continued to work there till 13.07.2004 and thereafter was transferred by respondent No.1 on 05.07.2004 to Government College Muktsar.

Further transfer of the petitioner was ordered to Government College Mandi Gobindgarh and thereafter was transferred on 04.09.2009 to Government CWP No.17510 o”

2. College for Girls, Patiala, where the petitioner is presently working as Assistant Professor.

All thorough from the date of taking over of the College by the Government, petitioner has not been granted any increments, rather it has been asserted that the service book of the petitioner has not been prepared by the respondents.

Reply to the writ petition has been filed by the respondents, wherein it has been stated that the petitioner till date has not been absorbed in Government Service and the claim of the petitioner for absorption and regularisation of the services has been referred to the Punjab Public Service Commission for its advice.

The case of the petitioner was forwarded to the Government on 28.8.2012 (Annexure R-2).Because of pendency of the case of the petitioner with the Punjab Public Service Commission, benefits as claimed by the petitioner in the present writ petition cannot be given as of now.

Counsel for the State on instructions from Ms.Baljinder Kaur, Senior Assistant, office of D.P.I.Colleges, Punjab, Chandigarh states that service book of the petitioner has been prepared and annual increments to the petitioner are being paid, except for the Selection Grade and the promotion which would be considered after receipt of advice from the Punjab Public Service Commission.

On considering the submissions made by the counsel for the parties, I am of the considered view that the present writ petition deserves to be disposed of with directions to the Punjab Public Service Commission, Punjab to finalise the case of the petitioner as has been sent to it vide memo dated 28.8.2012 (Annexure R-2) within a period of two months from the date of receipt of certified copy of the order.

3. Commission, on receipt, be considered by the respondents and appropriate orders pertaining to the grant of Selection Grade and claim for promotion, if any, be considered and decided within a further period of two months.

In case, the petitioner feels aggrieved that there is delay in grant of consequential benefits, which the petitioner is entitled to, the petitioner shall make a representation for the grant of interest on the delayed payment, which shall be considered and decided by the respondents within a period of three months from the date of receipt of such representation.
