The petitioner is said to have retired on 30th June, 2011, whileworkingasMaleSweeperunderMineralAreaDevelopment Authority,Dhanbad. Accordingtothepetitioner,thepostretirementduessuchas providentfund,arrearofsalary,interestofC.P.F,groupinsurance with interest, gratuity, leave encashment, differences of D.A of 50%,differences ofsixthpayrevision,D.A,RegionalAllowances, interimrelief,benefitofACP,differencesofCentralPayRevision, arrear of differences of time bound promotion and other retiral benefits have not been paid as yet, though he has made representationbeforetheRespondentsM.A.D.A.videAnnexure1. LearnedcounselfortheRespondentsM.A.D.Asubmitsthat ifthepetitionerapproachesthecompetentauthorityi.e.Managing Director, M.A.D.A., Dhanbad, with fresh representation for redressalofhisaforesaidgrievancesthesameshallbeconsidered in accordance with law as also the Scheme framed for retired employeesofM.A.D.A. Inthesecircumstances,inamatterrelatingtopaymentof post retiral dues, without commenting upon the claim of the petitioner, the writ petition is disposed of with liberty to the petitioner to approach the Manging Director, Mineral Area DevelopmentAuthority,Dhanbad,withafreshrepresentationfor redressalofhisaforesaidgrievances,withallsupportingfactsand documents, within a period of three weeks. On receipt ofsuch representation, the Manging Director, M.A.D.A., Dhanbad, shallconsiderthesameinaccordancewithlawandafterproper 2. verificationoftheservicerecordsofthepetitioner,passareasoned and speaking order, within a period of twelve weeks thereafter, whichshallalsobecommunicatedtothepetitioner.Iftheclaimof thepetitioneronaccountofsuchpostretirementduesandother servicearrearsarefoundtobegenuineandlegallyadmissible,the sameshallalsobedisbursedtohiminaccordancewiththescheme applicabletosuchretiredemployeesofMADAalongwithstatutory interest,ifany.
