Petitioner is widow of Late Raj Kishore Rai, who is said to have died on 29.5.2012 after his retirement from the post of In-charge Head Clerk in the District Transport Office, Jamshedpur on 28.2.2001. It is the grievance of the petitioner that most of the post retirement dues of the deceased employee have not been paid as also certain arrears of salary for the period from July 1998 to March 1999 and December, 1999 which have also not been paid. He was also entitled to the monetary benefits arising out of pay revisions, which has not been disbursed. Learned counsel for the petitioner has relied upon Annexure-4, communication dated 29.1.2013 issued by the Deputy Secretary, Transport Department, Government of Jharkhand to the District Transport Officer, East Singhbhum, Jamshedpur on the aforesaid subject . Annexure-3 is also in relation to the same subject matter. Learned counsel for the respondent- State submitted that, the delay in processing the post retirement benefits of the deceased employee i.e. husband of the petitioner is also attributable to the lack of interest of the husband of petitioner as would appear from Annexure-3 dated 11.9.2012 issued by the District Transport Officer, East Singhbhum, Jamshedpur. In these circumstances, having heard counsel for the parties and going through the relevant materials on record, the writ petition is disposed of without commenting upon the merit of the case by allowing the petitioner to approach the Respondent No.5, the District Transport Officer, East Singhbhum at Jamshedpur with a fresh representation together with all supporting facts and documents for redressal of her aforesaid grievances -2- within a period of 3 weeks. On receipt of such representation, respondent no.5, the District Transport Officer, East Singhbhum, Jamshedpur shall verify the service records of the deceased- husband of the petitioner and after due correspondence with the concerned department pass a reasoned and speaking order within a period of 12 weeks, thereafter. If the claim of the petitioner on account of post retirement benefits and other arrears of salary are found to be legally admissible, the same should also be disbursed within a further period of 8 weeks, thereafter.
