.....of 2012 for the offence under sections 302/ 34 of the indian penal code and section 3/ 4 of the prevention of witch practices act. the case relates to the murder of the mother of the informant and the informant is an eyewitness to the occurrence. though the petitioners are named in the f.i.r., but there is direct allegation against the other co-accused to have assaulted the deceased by spade causing her death. in the facts of this case, i am inclined to enlarge the petitioners, raban ansari and guljar ansari on bail. accordingly, the petitioners, named above, are directed to be released on bail, on furnishing bail bonds of rs. 10,000/- (ten thousand), each with two sureties of the like amount each, to the satisfaction of learned additional sessions judge-i, lohardaga, in connection with lohardaga p.s. case no. 74 of 2012 corresponding to g.r. no. 293 of 2012, s.t no.154 of 2012. For the State : A.P.P. ------ 7/ 19.08.2013 Heard learned counsel for the petitioners and learned A.P.P. for the Prosecution. The petitioners have been made accused in connection with Lohardaga P.S. Case No. 74 of 2012 corresponding to G.R. No. 293 of 2012, S.T No.154 of 2012 for the offence under Sections 302/ 34 of the Indian Penal Code and Section 3/ 4 of the Prevention of Witch Practices Act. The case relates to the murder of the mother of the informant and the informant is an eyewitness to the occurrence. Though the petitioners are named in the F.I.R., but there is direct allegation against the other co-accused to have assaulted the deceased by Spade causing her death. In the facts of this case, I am inclined to enlarge the petitioners, Raban Ansari and Guljar Ansari on bail.
