MISHRA For the Petitioner : Mr. Sanat Kumar Jha For the State : A. P.P. ----- 4/26.8.2013 Heard learned counsel for the petitioner and learned counsel for the State. Petitioner has been made accused for the offence under Sections 302/201 / 34 of the Indian Penal Code, in connection with Amrapara P.S. Case No.63 of 2010, corresponding to G.R. No.591 of 2010. (S.C. No.19 of 2011) The case relates to murder of the wife of the informant, who was also the daughter of this petitioner. The dead body of the deceased was recovered and the case was instituted against unknown. Learned Counsel for the petitioner submitted that petitioner has been falsely implicated in this case and has prayed for bail. Learned counsel for the State has opposed the prayer for bail submitting that there is statement of the eyewitness, who has stated that the petitioner had committed the murder of his daughter, and the weapon of offence was also recovered from the house of the petitioner. In the facts and circumstances of the case, I am not inclined to release the petitioner Doman Pahariya on bail. Accordingly, prayer for bail stands dismissed. (H. C. Mishra, J) R.Kumar
