We have heard the learned counsel for the petitioner quite in extenso. The request is that the Kerala Administrative Tribunal be directed to consider an original application pending before it expeditiously. For one thing, it is for the Tribunal to decide on the listing of cases before it. Secondly, and more importantly, this litigation is essentially a controversy as to whether the petitioner is eligible to be promoted even temporarily in preference to one of the private respondents. That is not for us to push through the table of the Tribunal with any expediency which is a matter best left to the Tribunal's discretion. For the aforesaid reasons, this original petition is O.P. (KAT) No.2599/13 -2- dismissed without expressing anything on merits and leaving the petitioner with liberty to move the Tribunal for appropriate orders, including for early listing of the matter pending at that end.
